Perte de temps \u2013 surestaries dues par l\u2019affr\u00e9teur. <\/strong>La clause de la c\/p disposant que l\u2019armateur accepte de d\u00e9charger en l\u2019absence du B\/L contre lettre de garantie ne cr\u00e9e pas un droit absolu de l\u2019affr\u00e9teur d\u2019obtenir la livraison et notamment lorsque ce dernier n\u2019a pas r\u00e9gularis\u00e9 la situation de la cargaison en s\u2019abstenant de payer son vendeur. Cette clause ne peut l\u00e9gitimer une fraude aux droits d\u2019un tiers.
