Award N°1171 – Shipbuilding contract for a tuna fishing vessel – Claim for contribution from third party. Amongst disorders ascertained by a court appointed surveyor following the delivery, the contractual guarantee for alleged out of alignment was not accepted because the proceedings to initiate it was not properly followed ; on the other hand, the shipyard was held liable in the frame of the guarantee for the spoiling of the fish tanks coatings jointly observed by the parties involved.
