Award N°1133 – B/L showing the loaded weight – Owners’obligation to discharge the B/L weight. Although a bill of lading contained the printed mention « weight, quality and quantity unknown », any such reference is contradictory, and thus void, with the indication borne on the said bill of lading of the precise loaded weight. Owners then were faced with the strict obligation to deliver the loaded quantity unless they can show evidences that any cargo shortage is not due to any fault of their own. Owners were therefore wise to reach an amicable settlement with consignees, but they do not have any recourse against charterers in this respect.
