Award N°1105 – Time-charter – Loss of containers loaded on deck in bad weather. Liability for loss of containers loaded on deck has to be shared between the timecharterer responsible for bad stowage and the owner responsible for the seaworthiness of the vessel (worn sockets, for example). An unreasonably high initial stability in bad weather contributed to the damages, as well as the error in navigation by the Captain.
