Award N° 1175 – (Second degree) : Carriage of bagged rice under B/L – Letter of guarantee – Damaged and shortage cargo at discharging – Shipowner liability. Damages and shortages to bagged rice shipments loaded in Karachi for discharge in Abidjan have been ascertained by surveyor reports carried out by cargo interests (Insurers). Despite their limits, survey reports enable the Arbitration Tribunal to accept tallies accuracy. The shipowner, in accordance with the rules of the 1924 Brussels convention, is condemned to pay insurance value of damaged and shortage cargo with the exclusion of tally expenses.
