Award N° 1103 – (Second degree) Vessel detained by Customs once loaded. The vessel was detained and obliged to offload her cargo at the port of loading following a Court decision rendered upon request of Customs and this situation arose because of a failure of shippers which, in terms of responsibility, binds Charterers. Neither the restraint of Princes, nor the force majeure arguments can be received. Owners are entitled to freight and demurrage. « Jus ex facto orator ».
